Remote Gambling
A license is required to operate online games of chance targeting the Dutch market. This license is called: Remote Gambling License. This license can be applied for at the Dutch Gambling Authority.
The license can be applied for in the following categories:
- Casino games in which the player plays against the licensee;
- Casino games in which the players play against each other;
- Bets on events during a sports match or on the outcome of a sports match;
- Bets on the results of horse races and harness races.
Applying for a remote gambling license is a costly and lengthy process in which various components must be submitted with the application. The requirements are listed below in a nutshell.
General Information
In Module A, general information must be provided about the legal form, address and contact details and which categories of games of chance will be offered. This includes an extract from the Chamber of Commerce and an Internal Organizational Chart.
Reliability & Integrity
In this module, the reliability of the applicant is tested. It is similar to a BIBOB investigation.
Research is carried out into group structures, business partnerships and criminal and administrative law antecedents.
VOGs (Certificates of Good Conduct) must be provided by all relevant persons, such as directors, ultimate beneficiaries and co-policymakers. An important part is the Network Drawing
Money Laundering and Terrorist Financing Prevention Act & Match-fixing
This module assesses how the applicant fulfills their Wwft (Money Laundering and Terrorist Financing Prevention Act) obligations. A Wwft and Match-fixing policy must be submitted that describes, for example, how the client investigation is carried out, unusual transactions are reported and mitigating measures have been taken to control match-fixing.
Sanctions Legislation
This module assesses how the applicant fulfills their Wwft (Money Laundering and Terrorist Financing Prevention Act) obligations. A Wwft and Match-fixing policy must be submitted that describes, for example, how the client investigation is carried out, unusual transactions are reported and mitigating measures have been taken to control match-fixing.
Financial Stability
An important part of the application is that the applicant is sufficiently financially stable. Among other things, it is tested how the Players’ assets remain guaranteed and the company has a certain degree of continuity.
In this module, the following documents are submitted, among other things: Player Funds Form, Continuity Form, Accountant’s Report and a security of € 50,000 is provided.
Consumer Protection
In this module, various policy documents must be submitted, including the Advertising Policy and the Addiction Prevention Policy. An Addiction Prevention representative must also be appointed by the applicant.
Business Processes
This module examines the applicant’s business processes. For example, the outsourcing policy, the integrity policy, the payment policy and the structure of internal supervision will be examined. .
Digital Communication
A key requirement of the application is connection to the Central Register of Exclusion of Games of Chance (CRUKS). The register is kept by the Gambling Authority and the applicant’s environment must be connected to it. This is tested in advance and confirmed in a release advice from the Gambling Authority. Another important part is access to the control database (CDB) by the Gambling Authority, which gains access to all information. For this, information must be provided using the CDB Questionnaire.
Gaming System
Finally, the entire technical section must be inspected by an inspection body designated for this purpose.
For example, the Gaming System, the Control Database and the Information Security System are inspected. The reports and a summary thereof are submitted to the Gambling Authority.
Costs
The minimum costs for an application are € 48,000, which is paid to the Gambling Authority for processing the application.
In addition, a financial security of € 50,000 must be provided to the Gambling Authority.
