When is enforcement applicable

In regulated markets, the risk of administrative enforcement is real. Government agencies such as municipalities, the Dutch Gaming Authority (Ksa), the Dutch Data Protection Authority (AP), or the Netherlands Food and Consumer Product Safety Authority (NVWA) have a wide range of sanction measures at their disposal. These include administrative fines, penalty payments, revocation of licenses, or even closure of a business.

Administrative enforcement occurs in cases of (alleged) violations of laws and regulations, such as:

  • Non-compliance with license conditions;
  • Violation of the Gambling Act, the Environmental Permitting Act (Wabo), or the General Data Protection Regulation (GDPR);

Penalty Payment Order

A penalty payment order is a measure where an administrative body imposes a financial incentive to end a violation. If the imposed order is not complied with, the penalty must be paid. We advise on the legal sustainability of the order and assist with objections and reviews.

An administrative fine is a monetary penalty imposed by a supervisory authority or administrative body without court intervention. This sanction is applied for violations of legal obligations, such as non-compliance with license conditions or reporting requirements. We assess the legality of the fine and conduct objection and appeal procedures if necessary.

A license can be revoked in cases of serious or repeated violations, or when there are doubts about the reliability of the license holder. This often has significant consequences for business operations. We defend against revocations and advise on corrective measures to retain the license.

Administrative enforcement means that an administrative body intervenes directly to end a violation, for example by closing a location or removing a structure.
