Permits for Holiday Parks

Do you want to organize an event and need a permit? We’d be happy to assist you.

Permits for Holiday Parks

Operating or redeveloping a holiday park in the Netherlands requires a careful legal approach. Municipalities are imposing increasingly stringent requirements on operating permits, partly due to concerns about undermining activities, permanent residency, and spatial planning. Westhoff Van Namen assists operators, investors, and property developers throughout the entire permit process – from application to objection and appeal.

Legal Challenges

The reintroduction of the permit requirement raises legal questions, particularly regarding compatibility with the European Services Directive. Various municipalities invoke public order and safety to justify the permit requirement, but this is not always legally sustainable. Our firm has conducted multiple proceedings challenging the validity of these permit requirements.

Additionally, Bibob assessments are often involved, where municipalities investigate potential risks of permit misuse. Legal assistance is essential here as well to challenge unjustified refusals.

When is a Permit Required?

When is a Permit Required?

Since the withdrawal of the Open-Air Recreation Act in 2008, there has been no national permit requirement for holiday parks. However, many municipalities have reintroduced a permit requirement for campsites and holiday parks through their General Local Ordinance (APV). This permit is required for:

  • Operating a holiday park or campsite;
  • Changing the designation or redevelopment of the site;
  • Providing accommodation or hospitality services;
  • Permanent residence in recreational housing.
